SB 108/LM (BR 1501) - T. Buford, A. Kerr, J. Carroll, E. Scorsone

     AN ACT relating to retirement for police and firefighters in urban-counties.
     Amend KRS 67A.345 to establish September 18, 2002 as the date for eligibility for continued participation in group health insurance for those who withdrew from service under a certificate; amend KRS 67A.402 to require members who purchase service credit to file an application no later than 60 days prior to the anticipated service purchase payment date and delete prohibition of the payments being considered accumulated contributions of the member; amend KRS 67A.404 to permit service credit purchases based on service only on or after September 18, 2002; amend KRS 67A.410 to permit retirement after 20 years of service only after September 18, 2002, and delete other provisions establishing service required for retirement; amend KRS 67A.430 to increase the minimum retirement annuity from $1000 to $1250; amend KRS 67A.460 to conform; amend KRS 67A.490 to increase from $300 to $1500 the death benefit as prescribed; amend KRS 67A.492 to increase from one to three years the time that a surviving spouse has to have been married to a member in order to receive the prescribed benefits and make the benefits provided available to surviving spouses of member who died on July 14, 2000, or thereafter; amend KRS 67A. 560 to delete the requirement that the commissioner of law of the urban-county serve as legal adviser to the board and permit the board to hire a private investigator to carry out it duties; amend KRS 67A.570 to permit the board to invest in international or other securities permitted under federal law; create a new section of KRS 67A.360 to 67A.690, relating to requirements for the maintenance, security, disposition, and transferal of private account information of members, former members, and retirees, to include the requirement for member authorization for the release of information, authorization of the delivery of copies of notarized records or an affidavit in lieu of personal testimony for subpoenaed information as prescribed, delivery requirements for such records or affidavits, requirements for transmittal and disposal of records used in depositions, and establishment of the acceptable means for the proof of such records.

SB 108 - AMENDMENTS


     SCS/LM - Retain original provisions, except add and amend KRS 67A.450 to conform; retain the commissioner of law as legal counsel; authorize the board to hire independent counsel; delete the authority of the board to hire a private investigator.

     HCS/LM - Retain original provisions but make payment of benefits retroactive to July 1, 2005; provide for lump sum payments to retirees or surviving spouses as prescribed; declare an EMERGENCY.

     HCA (1/Title, C. Hoffman) - Make title amendment; declare an EMERGENCY.
