AN ACT relating to motor carriers.
Create a new section of KRS 281 to define "rear impact guard" and "rear end protection" on motor carriers; require all motor carrier safety inspections to include an inspection of rear impact guard and rear end protection; require Transportation Cabinet to include violation of defective guard or protection in the out-of-service criteria used for safety inspections; permit a motor carrier cited solely for missing or defective rear guard when transporting livestock or perishable goods to continue to destination rather than being placed out-of-service; amend KRS 281.990 to establish a fine of $250 for violation; provide that for the first 90 days after the effective date, a motor carrier will be issued a courtesy warning as to the fine and out-of-service penalties that will occur for continuing to operate a motor carrier with a missing or defective rear impact guard or rear end protection.
