SB 144 (BR 1651) - J. Denton

     AN ACT relating to automobile insurance.
     Amend KRS 304.20-043, which prohibits an auto insurer from canceling, refusing to renew, or increasing the premium on a state employee's personal automobile insurance because of an accident which occurred while acting within the scope of employment while operating a state-owned motor vehicle, to broaden application of the statute to persons employed by law enforcement agencies, fire departments, or fire districts, and to persons licensed or certified by the board of emergency medical services.

SB 144 - AMENDMENTS


     SCS - Retain original provisions; provide that private automobile insurance premium protection covers an employee who is operating a motor vehicle leased or assigned by his or her employer, rather than a publicly owned motor vehicle; provide that operating an emergency or public safety vehicle in compliance with KRS 189.940, which exempts emergency vehicles from the state's traffic regulations when responding to an emergency, shall not be deemed to be exhibiting a disregard for the state's traffic laws; provide that an accident described in this Act shall not be recorded on the driving history of the employee; add and amend KRS 186.018 to provide that an accident described in this Act shall not be recorded on the driving history records of the employee.
