SB 173 (BR 1906) - B. Guthrie

     AN ACT relating to surgical assistants.
     Amend KRS 216B.015, expand definition of "intraoperative surgical care" to include assisting by a surgical assistant; amend KRS 311.866, make certification of surgical assistants voluntary; amend KRS 311.870 to KRS 311.890, limit administrative authority of the board to certified surgical assistants.

SB 173 - AMENDMENTS


     SCS - Amend KRS 311.864, allow certified surgical assistants to work for dentists or dental surgeons, define "certified surgical assistant," and "intraoperative surgical care"; amend KRS 311.866 to exempt individuals employed by or directly under the supervision of a physician, dentist, or dental surgeon; amend KRS 311.868 to adjust membership of the Advisory Committee for Surgical Assistants; amend KRS 311.870 to provide criteria for continuing education; amend KRS 311.882 and KRS 311.878, allow examination for certification from multiple organizations before July 1, 2007, afterwards, certification must be from an organization accredited by the Commission on Accreditation of Allied Health Education Programs; create a new section of KRS 311.864 to 311.890, permit a six-month temporary certificate subject to approval of the board.

     HCS - Retain original provisions; delete provisions for dentists and dental surgeons to supervise certified surgical assistants; amend the definition of "certified surgical assistant" to require certification by the National Surgical Assistant Association, the Liaison Council on Certification for the Surgical Technologist, or any other national certifying organization that is a member of the Commission on Accreditation of Allied Health Education Programs; exclude an employee of a physician, dentist, or dental surgeon who is assisting that physician, dentist, or dental surgeon with medical or dental procedures from the certification requirements; permit the Kentucky Board of Medical Licensure to promulgate administrative regulations to adopt the continuing education requirements established by the National Surgical Assistant Association, the Liaison Council on Certification for the Surgical Technologist, or any other national certifying organization that is a member of the Commission on Accreditation of Allied Health Education Programs; require surgical assistants to be certified by the National Surgical Assistant Association, the Liaison Council on Certification for the Surgical Technologist, or any other national certifying body that is a member of the Commission on Accreditation of Allied Health Education Programs; amend KRS 216B.015 to change the definitions for "certified surgical assistant" and "intraoperative surgical care" to be consistent with the definitions used in KRS Chapter 311; repeal KRS 311.882 which establishes the requirements for certification of surgical assistants prior to July 1, 2005.

     HFA (1, T. Burch) - Amend Section 5 to change deadline from before July 1, 2007 to before July 1, 2006; amend Section 6 to change effective date from after June 30, 2007 to after June 30, 2006.
