SB 210 (BR 2249) - T. Jensen, R. Stivers II

     AN ACT relating to civil actions.
     Create a new section of KRS Chapter 411 to allow a plaintiff in a civil action where comparative fault becomes an issue, where suit was initiated against the original defendant within the statute of limitations, where the original defendant alleges that a third party caused or contributed to the plaintiff's injury, and where the plaintiff would be barred by a statute of limitations from bringing a claim against that third party to either amend the complaint pursuant to Rule 15 of the Kentucky Rules of Civil Procedure or institute a separate action within ninety days of the filing of the first answer or amended answer alleging such third party's fault; establish that the new cause of action is not barred by any statute of limitations.

SB 210 - AMENDMENTS


     HFA (1, J. Gooch Jr) - Insert provision to create a new section of KRS Chapter 453 to set a maximum fee scale for attorney fees charged in negligence cases.

     HFA (2, J. Fischer) - Amend to provide that a person made a party to an action under provisions of the bill who is not at fault, shall be entitled to recover the costs of defending the action.

     HFA (3, S. Baugh) - Replace provisions of bill with a proposal to submit to the voters an amendment to the Constitution of Kentucky that would allow the General Assembly to create statutory provisions relating to medical malpractice, including provisions for alternative dispute resolution, statutes of limitation or repose, peer review, expert witnesses, certificates of merit, and collateral source payments.
