SB 229 (BR 2062) - D. Seum

     AN ACT relating to distilled spirits.
     Amend KRS 241.010 to make a technical correction; amend KRS 243.120 to permit transportation of distilled spirits by manufacturers for the limited purpose of promotional sampling; amend KRS 244.050 to permit two or more manufacturers to conduct a joint promotional sampling event at a licensed or unlicensed location in a wet territory.

SB 229 - AMENDMENTS


     SCS - Retain original provisions; amend Section 3 to specify manufacturers licensed under KRS 243.030(1) or (2); require manufacturers participating in a sampling event provide at least seven days notice to the Office of Alcoholic Beverage Control, specify that samples are limited to drinks to be consumed on the premises.

     HCS - Retain original provisions; amend definitions to include definition for "qualified historic site"; create a new section of KRS Chapter 242 to provide for local option elections for the limited sales of alcoholic beverages by the drink where a qualified historic site is located; amend KRS 243.030 and KRS 243.040 to establish a qualified historic site liquor license; create a new section of KRS Chapter 243 to provide the parameters of a qualified historic site liquor license; amend KRS 243.033 to require caterers serving on property owned, leased, or operated by the Commonwealth to have liability insurance coverage of not less than $1 million; amend KRS 244.500 to permit brewers to sell malt beverages packaged with novelty items if the price charged includes the cost of the novelty item.

     HCA (1/Title, D. Keene) - Make title amendment.

     HFA (1, R. Wilkey) - Clarify that the prohibition against a person licensed to sell malt beverages in KRS 244.500(1) does not prohibit a brewer, wholesaler, distributor, or retail licensee from selling malt beverages that are packaged with a novelty item if the price charged includes the cost of the novelty item.

     HFA (2/Title, R. Wilkey) - Make title amendment.

     HFA (3, D. Keene) - Retain original provisions; amend KRS 241.010 to define "qualified historic site" as a contributing property within a commercial district listed in the National Register of Historic Places; create a new section of KRS Chapter 242 to provide for local option elections for the limited sale of alcohol by the drink at qualified historic sites; amend KRS 243.030 to establish a qualified historic site license to sell alcoholic beverages; create a new section of KRS Chapter 243 to detail parameters of qualified historic site license; amend KRS 243.050 to include qualified historic sites.

     HFA (4/Title, D. Keene) - Make title amendment.

     HFA (5, W. Hall) - Retain original provisions; limit sampling events to no more than two per year and require that the sampling event must be in coordination with multi-state governmental conferences, or national or international sporting events.
