SB 230 (BR 2294) - V. McGaha, J. Pendleton

     AN ACT relating to captive cervid permits.
     Create a captive cervid holding permit; require Department of Fish and Wildlife Resources to promulgate administrative regulations relating to the permit within sixty days that are no more restrictive than the regulation currently in place other than the modifications required by this act; specify that the department has thirty days to act on a permit application; allow containment fence to be placed on the property line; allow permittee to expand his or her facility without requiring a new permit; allow permittee to transfer his or her permit after notifying the department.

SB 230 - AMENDMENTS


     SCS - Retain original provisions of SB 230; specify that nothing in the bill shall be construed to impair obligations imposed by statute or executive order, including a ban on the interstate importation of live cervids.

     SFA (1, V. McGaha) - Prohibit administrative regulations on fencing and holding requirements for captive cervids to be more stringent than regulations in place on January 5, 2004; make an exception to the stringency requirements for the Office of the State Veterinarian and the Department of Fish and Wildlife Resources for reasons of disease control; require the Department of Fish and Wildlife Resources to issue or deny permits for propagation and taking of captive cervids in 30 days; require the applicant for a captive cervid permit to remove all wild cervids from the facility; allow seizure and disposal of cervids held in violation of administrative and statutory requirements; impose a ban on the interstate importation of cervids; require the Department of Fish and Wildlife Resources and the Office of the State Veterinarian to issue reports to the Interim Joint Committee on Agriculture and Natural Resources.

     HCA (1, T. McKee) - Clarify that the language relates to statutes "pertaining to" the holding of cervids, not "prohibiting" the holding of cervids.
