AN ACT relating to the licensing of athletic agents.
Create a new section of KRS 164.6901 to 164.6935 to establish the Kentucky Sports Agent Licensing Authority to regulate athlete agents; amend KRS 164.6903 to broaden the definitions of "athlete agent" and "student athlete"; define "financial services," and "participation"; amend KRS 164.6907 to prohibit any person from knowingly aiding or abetting anther person conducting business as a unlicensed athlete agent; amend KRS 164.6911 to require that applicants be of good moral character and at least eighteen years of age; amend KRS 164.6915 to increase the initial application fee and the application by endorsement fee from $300 to $500; increase the annual renewal fee from $300 to $1,000; amend KRS 164.6917 to make contracts voidable and unenforceable in certain conditions; amend KRS 164.6923 to establish that failure to provide the department access to records is grounds for disciplinary action; amend KRS 164.6925 to establish additional grounds for disciplinary actions, to include: failing to pay within 30 days assets belonging to another over which the agent has control; exhibiting professional conduct that demonstrates bad faith or dishonesty; not maintaining a separate trust or escrow account for proceeds received for another person, and accepting a student athlete as a client in exchange for consideration paid to an employee or a coach for a college or university; amend KRS 164.6927 to make violations of Act for which a penalty is not already specifically provided a Class D felony; amend KRS 164.6929 to specify what constitutes a university's damages; amend KRS 164.6905, 164.6913, and 164.6919 to conform.
