SB 49 (BR 925) - R. Roeding

     AN ACT relating to gift cards.
     Create a new section of KRS Chapter 367 to provide minimum lengths of time for the expiration of gift cards issued by businesses or charitable organizations; limits service charges or fees that may have the effect of reducing the value of the card, and mandates that a gift card sold without an expiration date is valid until redeemed or replaced.

SB 49 - AMENDMENTS


     SCS - Retain all original provisions; add new language excluding cards issued by a merchant for a promotional program for which no separate monetary consideration is given.

     SFA (1, R. Roeding) - Exclude from the definition of a gift card ones that can be redeemed with other merchants in addition to the merchant that issued the card.

     SFA (2, R. Roeding) - Retain original provisions, but amend Section 1 to exclude a card that is usable with multiple, unaffiliated sellers of goods or services.

     SFA (3, R. Roeding) - Retain original provisions; amend Section 1 to exempt a general-use, prepaid card or other electronic payment device that is issued by a bank or other financial institution that is usable at multiple, unaffiliated merchants, or at automated teller machines, or both, from the definition of a "gift card."

     HCA (1, J. Bruce) - Create a new section of KRS Chapter 244 to prohibit a person under the age of 21 from redeeming a gift card or any portion of a gift card for the purchase of alcoholic beverages.
