AN ACT relating to reorganization.
Establish KRS Chapter 39G and create new sections to establish the Kentucky Office of Homeland Security and its duties; attach the office to the Office of the Governor; require the Governor to appoint the executive director of the Kentucky Office of Homeland Security; move the Commercial Mobile Radio Service Emergency Telecommunications Board of Kentucky from the Commonwealth Office of Technology to the Kentucky Office of Homeland Security; amend KRS 39A.050 to require that the director of the Division of Emergency Management notify the executive director of the Kentucky Office of Homeland Security of all major emergencies and disasters and all responses to these events; amend KRS 36.010, 39A.070, 11.5163, and 39A.283 to conform; repeal KRS 36.224 and 39A.287; confirm Executive Order 2005-563.
SB 59 - AMENDMENTS
HCS - Retain original provisions; make a technical correction in Section 4 attaching the Commercial Mobile Radio Service (CMRS) Emergency Telecommunications Board to the new Office of Homeland Security; amend KRS 11.507, 11.512, and 65.7623 to conform to the transfer of the CMRS Board from the Commonwealth Office of Technology to the Office of Homeland Security; amend KRS 12.023, relating to administrative bodies attached to the Office of the Governor, to include the Office of Homeland Security.
HFA (1, M. Cherry) - Make a technical correction in the new section attaching the Commercial Mobile Radio Service (CMRS) Emergency Telecommunications Board to the Office of Homeland Security; amend KRS 11.507, 11.512, and 65.7623 to conform to the transfer of the CMRS Board from the Commonwealth Office of Technology to the Office of Homeland Security; amend KRS 12.023, relating to administrative bodies attached to the Office of the Governor, to include the Office of Homeland Security.
HFA (2, J. Barrows) - Require the executive director of the Office of Homeland Security (OHS) to inform members of the General Assembly of the process by which a public agency applies for a federal homeland security grant and provide certain information to the members at least 90 days before an application deadline; require the adjutant general to notify the Governor and the executive director of the OHS of a disaster involving homeland security; require the adjutant general to be the Governor's primary point of contact for managing and responding to a disaster involving homeland security; require the OHS to directly notify the chief executive officer of each city, county, urban-county, charter county, and consolidated local government concerning grants for homeland security as soon as the grants become available; require the OHS written report to the Governor, the Auditor, LRC, and the Interim Joint Committee on Seniors, Veterans, Military Affairs, and Public Protection by November 1 instead of October 25; direct the state Auditor to examine revenues and expenditures provided under the OHS annual written report and under the OHS records, and, if examination findings warrant, to conduct audits; require the Auditor, by January 30, to submit examination and audit reports to the Senate Veterans, Military Affairs, and Public Protection Committee and the House Seniors, Military Affairs, and Public Safety Committee; direct the executive director of OHS to provide to the LRC and the Interim Joint Committee on Appropriations and Revenue a quarterly report on the receipt and expenditure of homeland security funds; specify the minimum contents of the report; require the initial quarterly report by October 15, 2006.
HFA (3, T. Riner) - Add a provision to require the executive director of the Office of Homeland Security to publicize the findings of the General Assembly stressing the dependence on Almighty God as being vital to the security of the Commonwealth by including the statutory provisions of KRS 39A.285(3) in its agency training and educational materials; require the executive director of the Office of Homeland Security to see that a plaque with the text of KRS 39A.285(3) be displayed at the entrance of the Emergency Operations Center; make conforming amendments.
