SB 65 (BR 1161) - G. Tapp, B. Guthrie, W. Blevins Jr, D. Harper Angel, D. Mongiardo, J. Pendleton
AN ACT relating to prescriptive authority for advanced registered nurse practitioners.
Amend KRS 314.011 to permit advanced registered nurse practitioners to prescribe but not dispense, controlled substances; establish conditions for each schedule of controlled substances prescribed; limit the prescribing of psychostimulants to advanced registered nurse practitioners who are certified in psychiatric-mental health nursing and who provide either services at facilities defined under KRS Chapter 216B or who provide mental health-mental retardation services; require the advanced registered nurse practitioner who prescribes controlled substances to enter into a written collaborative agreement with a physician; prescribe the parameters of and the conditions imposed by the agreement; require the agreement to be forwarded to the Board of Nursing and the Board of Medical Licensing; require the prescribing advanced registered nurse practitioner and the collaborating physician to have the same or similar specialty qualifications; require the advanced nurse practitioner to obtain certification from the U. S. Drug Enforcement Agency; amend KRS 314.042, 314.195, and 218A.010 to conform; amend KRS 218A.202 to permit the Cabinet for Health and Family Services to provide data to the Board of Nursing concerning nurse practitioners who are associated with a physician or nurse practitioner who is under investigation for improper prescribing practices or in a geographical area where there is either a trend report or report on a nurse practitioner or physician which indicates a substantial likelihood that inappropriate prescribing may be occurring.
SB 65 - AMENDMENTS
SCS - Retain original provisions, except delete language authorizing advanced registered nurse practitioners to prescribe refills of Schedule V drugs for a 12 month supply and replace with language limiting their authority to a six month supply; restructure the composition of the controlled substances formulary development committee to require that a physician member serve as co-chair with the nurse practitioner chair; clarify that a nurse practitioner seeking licensure by endorsement in Kentucky must be in good standing in the original state where she was licensed, registered, or certified as a nurse practitioner.
HFA (1, D. Floyd) - Limit prescriptions issued by advanced registered nurse practitioners for Schedule II controlled substances classified under KRS 218A.060 to a 24-hour supply rather than a 72-hour supply.
HFA (2, M. Denham) - Retain original provisions except require that an ARNP pass a written test by the Kentucky Board of Nursing; require 5 years of experience before applying for authorization to prescribe controlled substances.
HFA (3, H. Cornett) - Delete provision allowing nurse practitioners to prescribe Schedule II drugs; delete provision allowing nurse practitioners at mental health facilities to dispense psychostimulants; clarify that no more than a 30-day supply of Schedule III controlled substances may be prescribed by an advanced registered nurse practitioner.
HFA (4, H. Cornett) - Limit nurse practitioners' prescriptive authority to prescribing nonscheduled legend drugs and Schedules IV and V controlled substances.
HFA (5, H. Cornett) - Limit prescriptive authority to Schedules III, IV, and V controlled substances; delete language relating to prescribing Schedule II controlled substances and psychostimulants by advanced registered nurse practitioners engaged in a mental health practice; limit the prescribing of Schedule III drugs to a 72-hour rather than 30-day supply.
