SB 91/LM (BR 927) - J. Denton, E. Worley

     AN ACT relating to licensing massage therapists.
     Amend KRS 309.350 to delete language from definition of "practice of massage therapy"; amend KRS 309.353 to delete the letters "M.T." as an appropriate abbreviation for a licensed massage therapist; amend KRS 309.355 to add language that requires the board to investigate alleged violations brought to its attention and gives it subpoena power; amend KRS 309.357 to clarify renewal fees up to 60 days before and after licensure expiration; amend KRS 309.358 to include the National Certification Board for Therapeutic Massage and Bodywork as a certifying agency; amend KRS 309.359 to allow the board to grant reciprocity to individuals who it deems worthy and who transfer from states or countries with standards below Kentucky's; amend KRS 309.361 to allow the board to approve waivers or extensions of continuing education requirements; amend KRS 309.362 to create an inactive license and a license fee for massage therapists who do not choose to renew and a process to regain active status when appropriate; amend KRS 309.363 to update curriculum requirements and staff qualifications; create new section of KRS 309.350 to 309.364 to address misdemeanor violations and fines for offenses committed by massage therapists and for the board to apply to Franklin County Circuit Court to enjoin illegal acts and practices.

     SFA (1, J. Denton) - Restore language deleted from KRS 309.350 relating to the definition for practice of massage therapy; amend KRS 309.355 to delete the board's subpoena power and restore authority to institute criminal proceedings to Commonwealth's attorneys and county attorneys; amend KRS 309.362 to limit fines to $500 or less; revise new section of KRS 309.350 to 309.364 to delete prior penalty provisions and make violation a Class B misdemeanor.
