     AN ACT relating to railroad security.
     Create new sections of KRS Chapter 277 to require each railroad company operating in Kentucky to create a risk assessment of all facilities no later than January 1, 2008; establish guidelines for the preparation and reporting of the risk assessment; require each railroad company operating in Kentucky to establish a community protection plan to protect railroad infrastructure from acts of sabotage, terrorism, and other crimes; establish guidelines for the preparation of the community protection plan; require contractors and subcontractors working on railroad facilities to hire employees who meet the same standards as railroad company employees; prohibit a railroad company, contractor, or subcontractor from retaliating against an employee who reports a violation of the Act; allow the Transportation Cabinet to fine any railroad company, contractor, or subcontractor for noncompliance with the Act; establish the fine as up to $50,000 per day for noncompliance.
