HB 138/LM (BR 66) - D. Keene, D. Osborne

     AN ACT relating to alcoholic beverages.
     Amend KRS 241.010 to define "qualified historic site"; create a new section of KRS Chapter 242 to authorize local option elections for the limited sale of alcoholic beverages by the drink at qualified historic sties; amend KRS 243.030 to provide for a licensing fee for qualified historic sites selling alcoholic beverages by the drink; amend KRS 243.040 to provide a malt beverage licensing fee for qualified historic sites; create a new section of KRS Chapter 243 to specify the authority and limitations of a qualified historic site license; amend KRS 243.050 to allow the issuance of a license for a qualified historic site in the interest of tourism promotion; amend KRS 244.500 to permit novelty items to be sold with malt beverages if the cost of the novelty item is included in the purchase price.

     SCS/LM - Retain original provisions; amend Section 1 to expand the definition of "limited restaurant" to include a restaurant with a minimum seating capacity of 50 that has no bar; require that alcoholic beverages be sold in conjunction with the sale of a meal; amend the definition of a "qualified historic site" to mean a contributing property with dining facilities for at least 50 and lodging on the premises within a commercial district listed in the National Register of Historic Places, or a site listed as a National Historic Landmark with dining facilities for at least 50 and lodging on the premises and including a distillery listed as a National Historic Landmark with a souvenir retail liquor license; create Section 8 to provide for a local option election for the sale of alcoholic beverages by the drink at restaurants and dining facilities that seat a minimum of 50 people and derive a minimum of 70 percent of their gross receipts from the sale of food if beverages are purchased in conjunction with a meal; amend KRS 243.033 to extend caterers' licenses to serve malt and alcoholic beverages in cities and counties in which a local option election as specified in Section 8 was adopted.

     SCA (1, G. Tapp) - Create new sections to amend KRS 244.290, KRS 244.295, and KRS 244.480 to permit counties containing an urban-county government where Sunday sales of distilled spirits, malt beverages, and wine by the drink have been previously approved to establish by ordinance the hours during which the alcoholic beverages may be sold.
