     AN ACT relating to the funding of local jails.
     Create a new section of KRS Chapter 441 to provide that the state will reimburse counties at the regular per diem rate for holding individuals charged with violating a state law prior to final sentencing; phase full reimbursement in over four years, beginning July 1, 2008.

HB 187 - AMENDMENTS


     HCS/FN/LM/CI - Delete original provisions; create several new sections of KRS Chapter 304 and amend KRS 304.17B-015 to require health insurance plans issued on or after the effective date of the Act to cover an insured charged with a violation of the law who has not been finally sentenced; provide that such coverage will be primary; amend KRS 441.045 to provide that the amount counties shall pay for care provided by physicians, hospitals, laboratories, or other health care providers shall not exceed the maximum payments permitted under the Kentucky Medical Assistance Program; establish a task force to examine county jails and the criminal justice system.

     HCA (1/Title, R. Webb) - Make title amendment.

     HFA (1, J. Richards) - Retain original provisions; amend Section 7 to require health care providers that participate in the Medicaid program to provide health care services to any prisoner in a county jail and to accept the same rate of payment as is received from Medicaid for the same or similar services; create a new section of KRS 205.510 to 205.630 to require health care providers that participate in the Medicaid program to provide health care services to any prisoner in a county jail and to accept the same rate of payment as is received from Medicaid for the same or similar services.

     HFA (2, J. Richards) - Retain original provisions; add the provisions of Section 1 of House Bill 551.
