HB 210/AA (BR 817) - J. Gray, J. Vincent, D. Butler, M. Cherry, T. Couch, C. Embry Jr, D. Graham, R. Nelson, C. Rollins II, J. Stewart III

     AN ACT relating to classified employee's benefits.
     Amend KRS 158.070 to permit public school employees other than teachers to participate in statewide professional meetings with substitutes when needed; amend KRS 161.011 to define "progressive discipline" as a process to deal with job-related behavior that does not meet expected and communicated performance standards; establish due process and hearing procedures for classified employees notified that their contracts will not be renewed; require the board policy to provide a process that includes for verbal and written warnings, public and private reprimands, probation with a corrective action plan, and suspensions with pay or without pay of up to seven days prior to termination; establish due process procedures for an employee who has completed four years of continuous active service; establish a process to require the commissioner of education to appoint a hearing officer upon request; establish the right of appeal to the Circuit Court in the county where the school district is located; provide service credit for limited status employees on approved military leave and for reemployment or reinstatement of an employee inducted into the Armed Forces of the United States.

HB 210 - AMENDMENTS


     HFA (1, D. Floyd) - Amend KRS 157.3175 to require, beginning with the 2008-2009 school year, a school district to provide a preschool education program for each child who is at risk of educational failure and who is 4 years of age by August 1, rather than October 1; amend KRS 157.226 to establish, beginning with the 2008-2009 school year, that a child with a disability shall be eligible for a free and appropriate preschool education if he or she is 3 or 4 years of age, or who may become 5 years of age after August 1, rather than October 1; amend KRS 158.030 to permit, beginning with the 2008-2009 school year, any child to enter the primary program if he or she is 5 years old or may become 5 years old by August 1, rather than October 1.

     HFA (2/Title, D. Floyd) - Make title amendment.

     HFA (3, F. Rasche) - Require the school district to be responsible for the costs of the hearing officer and the administrative hearing; make technical corrections.
