HB 214/LM (BR 837) - S. Riggs, C. Hoffman, D. Horlander, R. Nelson, F. Nesler, J. Vincent, R. Webb

     AN ACT relating to law enforcement.
     Amend various sections of KRS Chapter 15 to include Kentucky Vehicle Enforcement officers and designated officers employed by the Kentucky State Police to the list of police officers eligible for the Law Enforcement Foundation Program fund; amend various other sections to conform; amend KRS 15.430 to delete the provision for appropriations to the Law Enforcement Foundation Program fund from the general fund of the Commonwealth of Kentucky and prohibit moneys in the fund from lapsing; amend KRS 15.450 to permit the secretary of the Justice Cabinet to withhold or terminate payments to any police officer that does not comply with the requirements of eligibility of the fund; amend KRS 15.460 to increase the annual amount paid to a unit of government from the fund for each eligible officer from $2750 to $3100 and delete the provision for an additional $3000 annual supplement; amend KRS 15.510 to require appeals for the withholding or termination of payment from the fund to be taken to Franklin Circuit Court; amend KRS 15.520 to clarify that its provisions apply exclusively to local police officers.

     HCS/LM - Retain most Kentucky Law Enforcement Foundation Program Fund (KLEPF) provisions; delete Kentucky State Police from bill; add the following agencies' law enforcement officers and investigators to the KLEPF program Kentucky Vehicle Enforcement, school security officers, Department of Alcoholic Beverage control, Division of Insurance Fraud, county detectives, Department of Fish and Wildlife, Attorney General, Department of Parks, police, Department of Agriculture; retain appeals in the local circuit court rather than move appeals to Franklin Circuit Court; delete amendment of KRS 15.520 relating to complaints against police officers; add amendment of KRS 95A.250 to increase the Firefighters Salary Supplement to $3,100; add amendment of KRS 42.190 and 95A.220 relating to moneys in the KLEPF fund and Firefighters fund to conform.

     HCA (1, K. Stein) - Make title amendment.

     HFA (1, S. Riggs) - Clarify that both the Firefighters Foundation Program fund and the Law Enforcement Foundation program funds are both trust and agency accounts and that the funds in each account, regardless of the source, shall not lapse at the end of any fiscal year.

     HFA (2, S. Riggs) - Retain most original provisions, except amend 15.440, relating to the Kentucky Law Enforcement Foundation Fund Program, to include the police officers bill of rights; KRS 15.520, in references, to delete reference to Kentucky State Police participation in KLEPF fund; add reference to Kentucky Horse Park mounted patrol officers in KLEPF fund; amend bill to insert KRS 15.520, relating to complaints against police officers, also known as the police officers bill of rights, to extend the provisions of the section to all peace officers receiving KLEPF funds and not just local officers.

     HFA (3, S. Riggs) - Retain most original provisions, except amend KRS 15.440 relating to Kentucky Law Enforcement Foundation Program funds to include Kentucky Horse Park mounted police officers and delete reference to Kentucky State Police participation; amend to insert KRS 15.520, relating to complaints against police officers, also known as the police officers bill of rights, to extend provisions to all police officers receiving KLEFP funds and not just local officers; amend to delay implementation of KLEFP fund payments to newly added entities until July 1, 2008; make technical corrections.

     HFA (4, S. Riggs) - Retain original provisions; amend KRS 15.420 to more clearly describe officers that meet the definition of "police officer" and to include additional police officers effective January 1, 2009 if the General Assembly determines that sufficient funds are available; amend KRS 15.430 to provide that additional police officers will be added to the fund if the General Assembly determines that sufficient resources are available; clarify language regarding money included in the Kentucky Law Enforcement Foundation fund and the Kentucky Firefighters Foundation fund; make technical corrections; amend KRS 15.520 to conform.
