HB 240 (BR 1047) - M. Denham

     AN ACT relating to solid waste.
     Amend KRS 109.056 to allow local governments to enact an ordinance that will provide for the collection of a person's outstanding solid waste taxes or fees through a lien on the person's motor vehicle.

HB 240 - AMENDMENTS


     HCS - Retain original provisions of the bill, but extend provisions to unified local governments; provide that any liens placed upon a vehicle for unpaid county or waste management district solid waste taxes or service fees shall be inferior, rather than superior, to all other liens on the vehicle.

     HFA (1, M. Denham) - Require any ordinance enacted relating to the collection of solid waste fees or taxes to follow the procedures for the collection of delinquent motor vehicle ad valorem taxes provided by KRS 134.810 and provisions regarding vehicle registration renewal and transfer contained in KRS 186.021; delete references to lien requirements.

     SCS - Amend KRS 109.056 to allow local governments to collect delinquent solid waste collection taxes or fees through contract with the Department of Revenue; allow Department to collect 20% additional for collection; require Department to distrain any taxes or personal property, excluding liens on motor vehicles.

     SFA (1/Title, D. Roeding) - Make title amendment.

     SFA (2, D. Roeding) - Retain original provisions; provide for merged county sheriff's departments and collection of certain fees.
