HB 358/LM (BR 1058) - L. Combs
AN ACT relating to criminal justice.
Create a new section of KRS Chapter 15 to provide for revocation of peace officer certification; amend KRS 15.382 relating to peace officer qualifications to add a bad conduct discharge from military as a disqualification; amend KRS 15.386 relating to peace officer returning to duty to specify required courses; amend KRS 15.392 placing an officer on inactive status to permit revocation of certification for cause; amend KRS 15.404 relating to inservice training to provide for extending time to take inservice training in extenuating circumstances; amend KRS 18A.202 relating to employee suggestion program to permit State Police employees to participate; amend KRS 197.025 relating to Dept. of Corrections open records procedures to clarify response time at 5 days and provide for confidential regulations; create a new section of KRS Chapter 197 relating to prisons to specify that when a prisoner is transported to a civil law suit as a witness the person requesting the attendance of the prisoner shall pay transportation and related costs and provide for video teleconferencing when possible; amend KRS 213.011 relating to definitions for vital statistics chapter to clarify definition of Sudden Infant Death Syndrome (SIDS) and provide for expanded investigation; create a new section of KRS Chapter 605 relating to juvenile justice to limit access to juvenile records and information which is security sensitive and specify open records request procedures; amend KRS 610.265 and 630.080 relating to detention of children to eliminate oral report and retain written report; amend KRS 600.020 relating to definitions for the juvenile code to specify that a "child" includes a person who was under 18 when determined to be a status offender, public offender, or a youthful offender who is detained by the District Court after the offender's 18th birthday as provided by law; amend KRS 15.330 for technical amendment.
HB 358 - AMENDMENTS
HCS/LM - Retain most original provisions, except delete reference to Sudden Infant Death Syndrome; delete all references to the Unified Juvenile Code, KRS Chapters 600 to 630.
HFA (1, L. Combs) - Amend to clarify that a person who has attained the age of 18 years may remain within the definition of "child" for treatment purposes in specified public offense situations.
HFA (2, R. Webb) - Amend to provide that use of technology for testimony of inmate witness in civil action is encouraged but not mandatory.
SFA (1, D. Roeding) - Attach provisions of SB 31.
