HB 394 (BR 1617) - J. Jenkins

     AN ACT relating to ophthalmic dispensers.
     Create a new section of KRS Chapter 326 to authorize the licensing of "optical establishments" operated by ophthalmic dispensers; delineate duties of the Kentucky Board of Ophthalmic Dispensers regarding licensing; describe conditions for applicants and licensees pertaining to licensing optical establishments; amend KRS 326.010 to define "optical establishment," a term that excludes establishments that come under the practice of medicine, osteopathy, or optometry; amend KRS 326.070 to indicate that KRS Chapter 326 does not require physicians, osteopaths, or optometrists to obtain a license for an optical establishment for their office, place of business, or practice; amend KRS 326.090 to list misconduct for which the board may deny applicants or discipline licensees; make technical corrections.

HB 394 - AMENDMENTS


     HFA (1, J. Jenkins) - Retain original provisions, except delete new language granting the ophthalmic dispenser board the power to promulgate administrative regulations requiring the presence of specified equipment at each licensed optical establishment; remove new references to "related accessories" and return references to "appurtenances thereto."

     SCS - Retain original provisions, except delete new section requiring a license to operate an optical establishment; remove licensing exemptions and board disciplinary powers regarding optical establishment licenses; permit the board to impose a fine against any person who operates an optical establishment without the supervision of a Kentucky-licensed ophthalmic dispenser, any person who allows unlicensed persons to perform activities that violate KRS 326.030, or any person who allows a Kentucky-licensed ophthalmic dispenser to supervise more than one optical establishment at the same time; amend KRS 326.100 to extend the board's actions and the related right to a KRS Chapter 13B hearing to apply to a "person" rather than just a "licensee."
