HB 405 (BR 1355) - D. Owens

     AN ACT relating to elections.
     Amend KRS 117.235 to expand the class of persons permitted in a voting room while a vote is being cast; amend KRS 117.255 to clarify who is eligible to assist a voter; amend KRS 117.275 to permit nonpartisan candidates to witness and check the vote count; amend KRS 117.995 to create a penalty for violations of certain election provisions; amend KRS 119.056 to clarify circumstances for penalties regarding violations of certain election provisions.

HB 405 - AMENDMENTS


     HCS/LM - Retain original provisions; amend KRS 117.995 to provide a penalty for violating the provisions related to assisting a voter in casting a vote.

     HFA (1, D. Owens) - Remove language limiting those who would be eligible to assist a voter in casting his or her vote.

     HFA (2, J. Comer Jr) - Create a new section of KRS Chapter 117 to require the State Board of Elections to conduct an audit whenever more than 15 percent of the votes cast in an election are cast by absentee ballots; require that results be turned over to the Attorney General, Commonwealth's Attorney, and appropriate county attorney.

     HFA (3, D. Owens) - Amend KRS 118.215 to provide that during a presidential election year, the Secretary of State shall certify the nominations no later than the Monday after the Friday following the first Tuesday in September; amend KRS 118.365 to conform.
