     AN ACT relating to energy independence.
     Create a new section of KRS Chapter 45A to encourage the Finance and Administration Cabinet to develop a strategy to utilize the ENERGY STAR system in new construction designs for proposed state facilities and measure the energy efficiency of existing facilities; direct the Finance and Administration Cabinet to develop a strategy to replace state-owned passenger vehicles and light trucks with alternative fuel vehicles; require the Cabinet to report to the Legislative Research Commission on or before December 31, 2007; create new sections of KRS Chapter 139 to create an exemption for tangible personal property used in the construction, repair, renovation, or upgrade of an "alternative fuel or renewable energy facility"; authorize a sales and use tax refund for machinery and equipment purchased by a manufacturer for an "energy efficiency project", define terms; require prior approval from the Department of Revenue; provide that approvals cannot be granted before July 1, 2008; require reporting to the Department of Revenue, and the department to report to LRC; amend KRS 141.0405 to allow an alternative fuel or renewable energy facility to qualify for the coal incentive tax credit for tax periods beginning after December 31, 2008 and ending before January 1, 2021; amend KRS 154.22-010, 154.23-010, and 154.28-010 to allow an alternative fuel or renewable energy facility to qualify for various economic development incentives for tax years beginning after December 31, 2008; creates a new section of KRS Chapter 152 to direct the Office of Energy Policy to develop a list of potential sites suitable for development of alternative fuel or renewable energy facilities; provide that state funds may be expended for preliminary environmental and baseline assessments, inventories, and other activities on or for potential sites.

HB 5 - AMENDMENTS


     HCS (1) - Retain original provisions; remove requirement that alternative fuel or renewable energy facility be new; include operators of alternative fuel or renewable energy facilities in sales tax exemption.

     HCS (2/FN) - Retain the original provisions, create a new section to provide new definitions for "alternative fuel facility" and "renewable energy facility", amend various sections to incorporate new definitions, and make technical changes.

     HCA (1/Title, H. Moberly Jr) - Make title amendment.

     HFA (1, R. Adkins) - Create a new section of KRS Chapter 45A to encourage the Finance and Administration Cabinet to use Leadership in Energy Environmental Design to promote design, construction, and operation of high-performance energy efficient buildings; encourage state agencies to review utility usage and implement Energy Savings Performance Contracts where appropriate; make technical changes.

     SCS - Create a new section of KRS Chapter 45A to encourage the Finance and Administration Cabinet to develop a strategy to utilize the LEED system in new construction designs for proposed state facilities, to encourage the use of energy savings performance contracts for existing facilities, and to encourage the use of ENERGY STAR products; direct the Finance and Administration Cabinet to develop a strategy to replace state-owned passenger vehicles and light trucks with alternative fuel vehicles; require the cabinet to report to the Legislative Research Commission on or before December 31, 2007; amend KRS 141.0405 to allow an alternative fuel facility to qualify for the coal incentive tax credit for tax periods beginning after December 31, 2008, and ending before January 1, 2021; increase the coal incentive tax credit cap for biodiesel; create new sections of KRS Chapter 353 to create the Kentucky Energy Development Authority and to outline authority's responsibilities including the awarding of incentives; create new sections of subchapter 27 of KRS Chapter 154 to provide incentives for alternative fuel facilities and renewable energy facilities; provide that state funds may be expended for preliminary environmental and baseline assessments, inventories, and other activities on or for potential sites for alternative fuel facilities or renewable energy facilities; create a new section of KRS Chapter 158 to define "advanced science and mathematics"; create a new section of KRS Chapter 158 to establish the science and mathematics advancement fund to provide incentives for elementary, middle, and high schools to expand student access to rigorous curricula in science and mathematics; establish that funds shall be used to provide payments for teachers to attend summer institutes in advanced science and mathematics, support for high schools for advanced science and mathematics courses in high schools, grants to middle schools to support accelerated student learning in science and mathematics, professional development for elementary school teachers, scholarships to public high school students to take Advanced Placement (AP) science and mathematics courses through the Kentucky Virtual High School (KVHS), and grants to school districts for an energy technology career track; establish that the fund may receive funds from public and private sources; require funds to be distributed only after all other available funds have been obligated; require the Kentucky Board of Education (KBE) to promulgate administrative regulations; require the Kentucky Department of Education (KDE) to administer the fund, develop the application and approval process for the energy technology career track program, approve grant recipients, and distribute funds; require KDE to pay the fees, expenses, and stipends for advanced science and mathematics summer institutes for teachers; set forth the criteria to be taken into account for determining the amounts to be distributed to high schools; establish permissible uses of funds distributed to support advanced science and mathematics courses; require high schools receiving funds to provide assurances that all teachers will participate in summer institutes, and all students completing AP and International Baccalaureate (IB) courses will take the related examinations; require KBE to establish long-term and annual statewide goals; require KDE to develop and implement a program evaluation framework; require KDE to submit an annual report to LRC by December 1; create a new section of KRS Chapter 158 to require KDE to establish the Middle School Mathematics and Science Scholars Program; require the program to offer two-year renewable grants to middle schools to support intensive, accelerated student learning in mathematics and science; require that program offerings be provided at no cost to students; set forth activities that may be supported by the program; require that grant applications ensure that participants have the requisite skills and will receive ongoing, relevant professional development; require the program to focus attention on attracting members of subpopulations with academic achievement gaps to participate; amend KRS 156.160 to require KBE to promulgate administrative regulations to require courses of study or educational experiences in all middle and high schools to fulfill the prerequisites for advanced science and mathematics courses; amend KRS 156.553 to permit the teacher's professional growth fund to be used to provide professional development for teachers participating in the Middle School Mathematics and Science Scholars Program; amend KRS 156.555 to require the Center for Middle School Academic Achievement to assist Middle School Mathematics and Science Scholars Program grant recipients with professional development; amend KRS 158.007 to modify the definition of "Advanced Placement" or "AP" and "core curriculum"; amend KRS 158.622 to delete obsolete date references; amend KRS 158.6453 to require reporting on AP and IB participation and test scores on school report cards; amend KRS 160.348 to require KDE to make available to middle and high schools information regarding the prerequisites for success in secondary, AP, and IB courses; require KDE to provide instructional supports to teachers, including professional development for assisting students enrolled in the KVHS; require that all students with prerequisite courses shall be admitted to AP, IB, dual credit, or dual enrollment courses; require a school to permit a student to enroll in a course with the KVHS if the school does not offer it; require KDE to pay for the cost of AP and IB examinations for public school students, as soon as funds are available; establish that all middle school students shall have access to a rigorous curriculum; require each middle school to establish a policy on the recruitment and assignment of students to secondary work and require them to make secondary courses available to students; amend KRS 164.002 to modify the definition of "Advanced Placement" or "AP" and define "International Baccalaureate"; amend KRS 164.098 to delete obsolete date references; amend KRS 164.525 to require the Center for Mathematics to advise KDE and KBE regarding the Middle School Mathematics and Science Scholars Program; amend KRS 164.7874 to conform; amend KRS 164.7879 to provide a supplemental Kentucky Educational Excellence Scholarship (KEES) award to students who are eligible for free or reduced-price lunch based on AP or IB examination scores; amend KRS 164.7881 to eliminate retroactively the three-year limit on the extension of eligibility for a KEES award for a student who was unable to enroll or complete an academic term due to military service; amend KRS 164.7885 to require a school to submit AP and IB scores to the Kentucky Higher Education Assistance Authority, unless the authority receives the scores directly from the testing service; require a school to report a student's eligibility status for free or reduced-price lunch; require qualifying AP and IB scores to be included in the calculation of KEES awards; create a new section of KRS Chapter 161 to require the Education Professional Standards Board to develop a training program for school personnel to become online coaches to provide support to students enrolled in the KVHS; require, by July 1, 2009, at least one person in each middle and high school to have successfully completed the online coaches training; create a new section of KRS Chapter 157 to require local school districts, under certain conditions, to provide a salary supplement to teachers of chemistry, physics, or mathematics and to teachers of chemistry, physics, or mathematics employed in schools with a high concentration of students eligible for free or reduced-lunch; require the Education Professional Standards Board to promulgate administrative regulations.

     SCA (1/P, C. Borders) - Create a new section of KRS Chapter 164 to create the Academy of Mathematics and Science at Western Kentucky University; describe purposes and long-term goals; require advisory board be established; define role of Western Kentucky University; require academy students to participate in the state accountability testing program and have scores reported to home high schools; recognize WKU faculty as certified to teach secondary students in the academy; amend KRS 157.360 to identify how SEEK funds will be used in support of students at the academy; amend KRS 158.140 to authorize the academy to award diploma and local school districts to award a joint diploma; amend KRS 164.002 definitions; amend KRS 164.7874 to ensure that academy students qualify to earn KEES awards; identify that the first students will be enrolled with the 2007-2008 academic year.
