SB 10/LM (BR 152) - G. Tapp, D. Boswell

     AN ACT relating to heating, ventilation, and air conditioning and making an appropriation therefor.
     Create new sections of KRS 198B.650 to 198B.689 to require a permit for the installation of initial HVAC systems; establish requirements for permit; create exemptions from permitting process; grant the Office of Housing, Buildings and Construction the authority to promulgate administrative regulations for HVAC permitting process and impose fees to fund permitting process; grant local authorities the right to act as the agent for the office, enter into contractual relations to act as agent, and fix compensation of local inspectors; require HVAC inspectors to have at least six years' experience; forbid local authorities from establishing additional permitting or inspection programs for HVAC; establish an agency trust and surplus account for the fees to fund the HVAC permitting process; define the powers of HVAC inspectors to include "stop work" authority; allow county, city, or Commonwealth's attorneys, or the Attorney General, to represent the office or its agents; grant the Circuit Court where a violation occurs and the Franklin Circuit Court concurrent venue and jurisdiction for criminal action, and grant the Franklin Circuit Court appeals jurisdiction for criminal action; grant aggrieved parties administrative hearings in accordance with KRS Chapter 13B; amend KRS 198B.650 to define "initial heating, ventilation, or air conditioning system," "major repair," and "permit"; amend KRS 198B.990 to include infractions of the HVAC permitting process within the fines and punishment section; create a noncodified section to allow the initial funding of the program from existing agency trust and surplus accounts; require repayment of these accounts within two fiscal years; EFFECTIVE July 1, 2008.

SB 10 - AMENDMENTS


     SCS/LM - Retain original provisions; amend Section 1 to notwithstand KRS 198B.030; include Uniform State Residential Code in inspection requirements throughout; amend Section 2 to delete provision allowing inspection to be scheduled within 7 business days of notice; amend Section 3 to provide that all fees collected by an authorized local government permit office shall be retained by that local government; amend Section 6 to delete references to the Franklin Circuit Court; amend Section 7 to allow refusal to approve work in instances where the property owner refused to allow an inspection; amend Section 12 to extend the effective date for Sections 2, 5, and 7 until January 1, 2009.

     HFA (1, B. Farmer) - Amend Section 1 to exempt HVAC installation done in conformance with licensed engineering drawings or plans.
