SB 138 (BR 1269) - T. Buford
AN ACT relating to surgical technology.
Create a new KRS Chapter 311B and create various new sections to establish certification for surgical technologist; define terms; provide exemptions; establish the Kentucky Board of Certified Surgical Technologists to be attached to the Division of Occupations and Professions to consist of four certified surgical technologists ,two certified surgical assistants, and one physician; establish board's duties to include establishing qualifications, developing mandatory continuing education program, and establishing fees; authorize board to promulgate administrative regulations to oversee surgical assistant program; require the board to develop public information pamphlets with regard to surgical technologists; require the board to keep a file on complaints written about surgical technologists; establish a procedure for addressing and investigating complaints; require medical professionals who work with surgical technologists to report to the board the surgical technologist's behavior that may pose a threat to the public welfare; establish qualifications for certification and annual renewal; establish criteria for reciprocity; allow a grandfathering provision to qualifying surgical technologists prior to July 1, 2009; establish violations that the board may sanction and a process for a surgical assistant to appeal.
SB 138 - AMENDMENTS
SCS - Retain original provisions, except delete definitions of "delegating physician" and "direct supervision"; exempt individuals from the certification requirements if they are performing the duties of a surgical technologist under the direct supervision of a registered nurse while employed by an ambulatory surgical center; identify physician assistants as licensed rather than certified; remove references to physician delegation in descriptions of surgical technologist scope of practice; redefine personnel who have a reporting duty regarding surgical technologist work behavior from being those who are usually present in an operating room to being any person actually present in the operating room; correct "advisory committee" to read "board" instead; change reporting threshold from the person's "opinion" to the person's "knowledge"; narrow reporting requirement to knowledge of a "threat" to public welfare rather than knowledge of a violation of the chapter or a "continuing threat" to public welfare.
