SB 155 (BR 1598) - E. Harris, D. Boswell

     AN ACT relating to highway signs.
     Amend KRS 177.830 to define the terms "advertising device viewing zone," "cabinet," "permit," "trim or prune," "routine maintenance," "destroyed," and "routine change of message"; amend KRS 177.863 to make technical corrections; create new sections of KRS 177.830 to 177.890 to allow owner of legally erected advertising device to apply to the Transportation Cabinet for a vegetation control permit; set forth components of permit application; set forth a $100 nonrefundable permit fee; establish standards for approval of vegetation-control permit; establish the procedures for applicants who were denied a permit or issued a restricted permit to submit an amended application for a vegetation control permit; give the cabinet 30 days from the receipt of an amended application to respond to an amended application; allow an applicant that was issued a restricted permit or denied a permit based on an amended application to petition the Franklin Circuit Court to determine whether denial or restrictions were appropriate; amend KRS 177.860 to provide for the Transportation Cabinet to establish standards and routine maintenance and routine change of messages on advertising devices; create a new section of KRS Chapter 177.830 to 177.890 to establish a penalty of $100 per day for each day an illegal advertising device is in violation of KRS 177.830 to KRS 177.890.

SB 155 - AMENDMENTS


     HCS - Retain provisions of GA version of the bill with the following changes: change Section 3 of the bill to set forth the application process for vegetation control plans and set application fee at $200; make approved applications good for 7 years; add a new Section 4 to set forth procedures for receiving individual permits granted against an approved plan; set cost for individual permits at $150; make permits valid until cutting is completed or 6 months, whichever is shorter; require work to be supervised, rather than performed, by a certified arborist; require cabinet to promulgate administrative regulations to implement procedures for the application and permitting process; make technical corrections.

     HFA (1, S. Riggs) - Reduce the advertising device viewing zone to 300 feet in the direction the advertising device is facing and 150 feet past the advertising device if the advertising device is V-shaped or parallel to the highway.

     HFA (2, S. Riggs) - Reduce the advertising device viewing zone to 400 feet in the direction the advertising device is facing and 200 feet past the advertising device if the advertising device is V-shaped or parallel to the highway.

     HFA (3, T. Riner) - Add a new section to allow local governments to express opposition to issuance of vegetation control permits within their jurisdictions; prohibit the acceptance of applications for or issuance of vegetation control permits in areas where the local government has expressed its opposition to permits; allow that active permits issued before a local government expresses its opposition shall be valid until that permit expires; amend Sections 3 and 4 of the bill to conform.

     HFA (4, T. Riner) - Add a new section to require the Transportation Cabinet to establish a highway beautification program to allow trees and shrubs to be planted along highway rights-of-way; allow local governments to petition the cabinet to allow placement of plants; require local government to defray expense involved; require the cabinet to promulgate administrative regulations to carry out the provisions of the program.

     HFA (6, T.
