SB 196 (BR 1263) - R. Stivers II
AN ACT relating to permitting for industrial energy facilities.
Amend KRS 224.01-010 to define "industrial energy facility"; amend KRS 224.10-225 to make industrial energy facilities eligible for one-stop shopping for environmental permits; amend 224.10-470 to require that permitting appeals skip the circuit court level and be heard by the Court of Appeals; amend KRS 278.700 to exempt industrial energy facilities from Siting Board approval.
SB 196 - AMENDMENTS
SCS - Amend KRS 224.10-470 to change venue for review of final orders of the Environmental and Public Protection Cabinet for an industrial energy facility from the Court of Appeals to the Circuit Court located in the county where the industrial energy facility is proposed to be located.
SFA (1, E. Scorsone) - Remove industrial energy facility exemption from Kentucky State Board on Electric Generation and Transmission Siting review.
HFA (1, T. Pullin) - Delete other useful products from the definition of "industrial energy facility."
HFA (2, R. Webb) - Require a NEPA environmental assessment or environmental impact statement for industrial energy facility to be exempt from Siting Board purview.
