SB 205 (BR 1650) - D. Seum

     AN ACT relating to metropolitan sewer districts.
     Amend KRS 76.030 to provide that for metropolitan sewer districts (MSDs) in a county containing a consolidated local government that the board shall consist of 9 members 3 each appointed by the mayor, the Governor, and the legislative body of the consolidated local government; provide for criteria, qualifications, an annual salary of $5,000, removal, and specify appointment eligibility; create a new section of KRS Chapter 76 to provide that the board of the MSD shall contract with the Kentucky Auditor of Public Accounts for an annual audit, as well as audits required by the Public Service Commission (PSC); create a new section of KRS Chapter 76 to provide that in the district's monthly bill, a schedule of all regular meetings be enclosed for the 6 months following the ending service period of the bill; amend KRS 76.090 to provide that any proposed rates be sent in the monthly bill at least 90 days before the rates can be effective and that the district shall not change the schedule until 120 days after the notice is published, as well as requiring PSC approval for the new rate and fee schedule; provide that approval of the legislative body of the consolidated local government be required through an ordinance approved by the mayor must be gained before the rates can be effective; provide that subdistrict rates require approval of the PSC and in the case of a consolidated local government, the legislative body of a consolidated local government by ordinance approved by the mayor; amend KRS 76.262 to provide that for construction subdistricts, any proposed rates be sent in the monthly bill at least 90 days before the rates can be effective and that the district shall not change the schedule until 120 days after the notice is published, as well as requiring PSC approval for the new rate and fee schedule; provide that approval of the legislative body of the consolidated local government be required through an ordinance approved by the mayor must be gained before the rates can be effective; provide that subdistrict rates require approval of the PSC and in the case of a consolidated local government, the legislative body of a consolidated local government by ordinance approved by the mayor; provide that amendments to the schedule are subject to the requirements of the PSC; amend KRS 278.010 to include metropolitan sewer districts within purview of PSC.
