AN ACT relating to prosthetics, orthotics, and pedorthics.
Establish KRS Chapter 319B, regarding the licensing and regulation of practitioners of orthotics, prosthetics, and pedorthics; create a new section of KRS Chapter 319B to define terms for the chapter; create a new section of KRS Chapter 319B to establish the Kentucky Board of Prosthetics, Orthotics, and Pedorthics and its appointment and meeting procedures; create a new section of KRS Chapter 319B to delineate the duties of the board; require the board to administer and enforce the provisions of the chapter and to promulgate administrative regulations to establish factors for licensure and certification of licensed orthotists, prosthetists, and pedorthists, and certified orthotic fitters; create a new section of KRS Chapter 319B to state additional powers of the board, including the authority to employ needed personnel and contract with the Division of Occupations and Professions for the provision of administrative services; create new sections of KRS Chapter 319B to declare rules for actual physical licenses and certificates, practice authorization, and scope of practice; create a new section of KRS Chapter 319B to set a July 1, 2009, deadline for practice outside the provisions of the chapter; create new sections of KRS Chapter 319B to exempt individuals engaging in their profession from the authority of Chapter 319B, including licensed health care practitioners, physical therapists, occupational therapists, certain individuals working under the supervision and control of a licensed pharmacist, and listed types of orthotic, prosthetic, or pedorthic practice; create a new section of KRS Chapter 319B to forbid any person from practicing as or professing to be any of the licensed or certified professionals in the chapter without a valid current license or certificate; create a new section of KRS Chapter 319B to establish license expiration and renewal dates and procedures; create new sections of KRS Chapter 319B to authorize the board to grant reciprocity with other jurisdictions, discipline licensees or deny applicants for unprofessional conduct, and set fees within specified limits; create a new section of KRS Chapter 319B to list penalties for violations of provisions of the chapter.
SB 30 - AMENDMENTS
SCS - Retain original provisions, except reduce the number of board members from seven to five; limit the board's power to delineate standards of practice to only those persons licensed or certified under the chapter; indicate that care or services eligible for reimbursement by Medicare, Medicaid, or health insurance may only be provided pursuant to an order from a licensed physician; add physicians, chiropractors, and pharmacists to the list of professions whose practice cannot be limited or restricted by the chapter; remove individuals acting under the supervision of a licensed home medical equipment provider from the list of professions whose practice cannot be limited or restricted by the chapter; forbid application of the chapter to the practice of orthotics, prosthetics, or pedorthics by a licensed physician; modify all references to a "health care practitioner" to read "health care practitioner or provider" instead.
SFA (1, E. Scorsone) - Delete provision requiring the prosthetics, orthotics, and pedorthics board to bring an action for injunctive relief against those engaged in the unlicensed practice of prosthetics, orthotics, and pedorthics from the Franklin Circuit Court to the circuit court in the county where the violation occurred.
HCS (1/LM) - Retain original provisions, except require appointment of at least one pedorthist to the prosthetics, orthotics, and pedorthics board.
HCS (2/LM) - Retain provisions of HCS1; amend the Tourism Development Act to allow an approved company with over $70 million in approved costs to be granted a six-year extension, provided the company meets certain requirements and agrees to expend an additional 10% on capital expenditures; make conforming amendments.
HCA (1/Title, J. Jenkins) - Make title amendment.
HFA (1, J. Higdon) - Limit pedorthists who may be licensed by the board prior to July 1, 2009, to those pedorthists who are certified by the Board of Certification in Pedorthics, Inc.
HFA (2, J. Higdon) - Limit pedorthists who may be licensed by the board prior to July 1, 2009, to those pedorthists who are certified by the Board of Certification in Pedorthics, Inc.
