SB 82/FN (BR 1281) - B. Leeper

     AN ACT relating to brownfields redevelopment.
     Amend KRS 132.010 to provide definitions for "hazardous substances", "pollutant or contaminate", and "Release", and to provide for amended definition of "qualifying voluntary environmental remediation property"; amend KRS 132.020 to replace "bona fide prospective purchaser" with " "property owner" and amend the requirements for a property owner's qualification for a $0.015 per $100 ad valorum state tax rate, and replace the term "covenant not to sue" with "No Further Action Letter"; amend KRS 132.200 to replace "issuance of a covenant not to sue by the Environmental and Public Protection Cabinet for all known releases on the property" with "Environmental and Public Protection Cabinet's issuance of a No Further Action Letter or its equivalent", pursuant to the correction of the effect of all known releases of hazardous substances, pollutants, contaminants, petroleum, or petroleum products located on the property consistent with a corrective action plan approved by the environmental and Public Protection Cabinet..."; amend KRS 141.418 to define "Hazardous substances", "pollutant or contaminant", "petroleum", "petroleum products", and "Release", and amend the definition of "Qualifying voluntary environmental remediation property", and provide that taxpayers claiming a credit shall submit receipts to the Environmental and Public Protection Cabinet.
