     AN ACT relating to the advancement of energy policy, science, technology, and innovation in the Commonwealth, making an appropriation therefor, and declaring an emergency.
     Establish a new Subchapter 27 of KRS Chapter 154 to establish the Incentives for Energy Independence Act; create new sections of KRS Chapters 139, 141, and 143 to provide administrative direction for sales tax, income tax, and severance tax incentive under the Incentives for Energy Independence Act; amend KRS 141.310, 141.350, 42.4582, and 42.4585 to conform; create a new section of KRS Chapter 139 to provide a sales tax credit for energy-efficiency projects; amend KRS 141.0405 and 141.0406 to expand the coal credit to alternative fuel facilities and gasification facilities; amend KRS 141.422 to increase the cap for the biodiesel credit, to amend the definition of biodiesel, and to add definitions related to the new ethanol credits; amend KRS 141.424 to clarify application of the credit to blenders of biodiesel; amend 141.424 to clarify treatment of cooperatives; create new sections of KRS 141.422 to 141.425 to establish credits for ethanol and cellulosic ethanol; create a new section of KRS 141.422 to 141.425 to provide administrative direction for the ethanol credits; create a new section of KRS 141.422 to 141.425 to provide for a transfer of cap among the ethanol credits; amend KRS 141.0205 to conform; make technical corrections to KRS 141.428; amend KRS 56.770 to define new terms; amend KRS 56.776 to conform; create a new section of KRS 56.770 to 56.784 to encourage the Finance and Administration Cabinet to use the LEED or Green Globe rating systems and to incorporate ENERGY STAR products into state procurements; amend KRS 56.784 to encourage a review of utility usage in state-owned property; amend KRS 56.782 to require reporting; create a new section of KRS Chapter 45A to require a strategy for a cleaner state vehicle fleet; amend KRS 12.020 and 12.023 to move the Office of Energy Policy from the Commerce Cabinet to the Governor's Office; create a new section of KRS 152.710 to 152.725 to establish the Governor's Office of Energy Policy; amend KRS 152.725 to amend definitions; amend KRS 152.720 and 56.790 to conform; create a new section of KRS 152.710 to 152.725 to allow the Governor's Office of Energy Policy to expend state funds for preliminary work on sites; amend KRS 224.10-100 and 224.10-103 to conform; make technical corrections to KRS 141.430; create new sections of Subchapter 20 of KRS Chapter 154 to establish the Kentucky Alternative Fuel and Renewable Energy Program and fund; direct the PSC to make recommendations to the LRC by July 1, 2008; direct an LRC staff study on energy-efficient building and design practices; direct a study on carbon dioxide management; create a new section of KRS Chapter 164A to establish a student loan forgiveness program; create a new section of KRS Chapter 158 to establish an energy technology career track program in schools; require a collaborative of entities to make recommendations to the General Assembly regarding the creation of a center for renewable energy research and environmental stewardship; repeal KRS 152.750, 152.755, 152.760, 152.762, 152.765, 152.770, 152.775, 152.780, and 152.785; appropriate $5 million to the Kentucky Geological Survey for carbon sequestration and enhanced oil recovery research; appropriate $2 million to the Center for Applied Energy Research for alternative fuel production technology research; appropriate $300,000 to the Kentucky Department of Education for the energy technology career track program; appropriate $100,000,000 in bond funds with corresponding debt service to establish an energy projects economic development bond pool; EMERGENCY.

     HCS/LM - Retain original provisions except make technical amendments to various sections to correct drafting errors and to clarify intent.

     HFA (1, T. Riner) - Amend to require that energy facilities protect the health and welfare of employees and the environment.

     HFA (3, J. Wayne) - Expand the definition of renewable energy facility; and lower the investment threshold of certain renewable energy facilities.
