AN ACT relating to special districts.
Amend various sections of KRS Chapter 65 to require fiscal courts to designate which officers of special districts will be subject to the local code of ethics. Require special districts to submit a budget to the relevant fiscal court for review. Prevent any special district budget from taking effect until a budget is submitted to the relevant fiscal court for review. Authorize the county attorney to prevent the expenditure of any funds, if a special district does not comply. Make special districts with budgets of less than $200,000 subject to an audit every four years. Make special districts with budgets of more than $200,000 subject to annual audits. Require special districts to submit to fiscal courts a copy of the uniform financial information report submitted to the Department of Local Government.
HB 127 - AMENDMENTS
HCS - Retain original provisions of the bill but clarify in Section 1 that the governing body of the county will be the body which determines the application of the ethics code to special district officials; and clarify in Section 2 that the filing of the special district's budget with the fiscal court will be only for budget inspection purposes and for submission to the Department for Local Government.
SCS/LM - Retain reporting provisions of the original bill but delete requirements relating to local adoption of ethics codes for special districts.
