HB 157 (BR 1353) - P. Mason, S. Nunn

     AN ACT relating to long-term care.
     Amend KRS 205.217, relating to the Long-Term Care Case Management Demonstration Program, to redefine the term "case manager" to also include the duties of evaluation of quality and documentation of the absence of needed social and medical services for the requesting populations; change the program from a demonstration program to a program serving all area development districts; require the secretary for human resources to apply for any federal funding available for home and community based services that can increase access to needed but unavailable medical and social services as documented by the case manager; amend KRS 205.558 to require the secretary for human resources to annually evaluate the effectiveness of the statewide prescreening and admissions review system and report findings on odd-numbered years to the Governor and the Legislative Research Commission; amend KRS 216.515 to require long-term care facilities to inform applicants for admission to a facility of the average daily charges for services in the facility, that facility's policies regarding continuity of care when a resident's level of care changes, and the possibility of and the average length of stay within that facility of private pay residents before a resident usually spends-down into eligibility for the Kentucky Medical Assistance Program; direct facilities to provide residents with discharge planning; amend KRS 216.520 to require long-term care facilities to provide each resident upon admission to the facility with a pamphlet setting forth the residents bill of rights as provided under KRS 216.515 and 216.520; amend KRS 141.010 to exclude from taxation any amount paid for the purchase of long-term care insurance.
