AN ACT relating to civil actions.
Amend KRS 411.130 to prohibit a parent from obtaining wrongful death damages for the death of a minor when the parent owes child support in an amount that would be owed after one year of nonpayment; amend KRS 411.135 to prohibit a parent from obtaining extra wrongful death damages for the death of a minor when the parent owes child support in an amount that would be owed after one year of nonpayment.
HB 181 - AMENDMENTS
HCS - Change the requirement that to prevent a parent from recovering for the wrongful death of a child the parent has to abandon the child rather than have a child support arrearage of one year.
HFA (1, M. Brown) - Conform amendment to make provisions of the Act consistent with regard to preventing a parent from benefiting when that parent's child suffers a wrongful death and that parent has abandoned the child.
