     AN ACT relating to executive branch ethics.
     Amend KRS 11A.010 to define "lobbyist" to mean any person employed as a legislative agent as defined in KRS 6.611(22) or as an executive agency lobbyist as defined in KRS 11A.201(8); amend KRS 11A.040 to exempt purchases from a state agency which are available on the same terms to the general public or which are made at public auction, from the prohibition against public servants doing business with the state; prohibit a former officer or public servant for a period of six months from doing business with the agency by which he was employed; establish certain exemptions; prohibit a present or former officer or public servant, within six months following termination of state employment, from accepting employment by any person or business that is regulated by the state; direct that the post-employment provisions shall not prohibit an individual from returning to the same business, occupation, or profession for which he received, prior to his state employment, a professional degree or license; limit the post-employment prohibition against acting as a lobbyist or lobbyist's principal to matters in which the former public servant was directly involved during the last thirty-six months of his state employment; limit the prohibition against representing a person or business before a state agency to a matter in which the public servant was involved during the last thirty-six months of his state employment; amend KRS 11A.060 to delete violation of KRS 11A.040(5) or (6) as a cause for removal of a commission member; amend KRS 11A.990 to conform.

HB 272 - AMENDMENTS


     HFA (1, J. Wayne) - Create a new section of KRS Chapter 11A to permit a state agency to contract with a former officer or public servant within 6 months after the former officer or public servant leaves state employment concerning matters in which he was not directly involved during the last 36 months of state employment if the contract is limited to a period of 6 months or less and if the contract receives approval from the commission.
     SCA (1, A. Robinson) - Delete the provisions of HFA (1).
