HB 299/FN (BR 1512) - M. Marzian, J. Bruce, T. Burch, J. Crenshaw, S. Johns, M. Long

     AN ACT relating to traumatic brain injury.
     Create new sections of KRS Chapter 211 to define terms, establish the Kentucky Traumatic Brain Injury Trust Fund Board and to set forth its operating parameters and duties; create a new section of KRS Chapter 211 to establish the traumatic brain injury trust fund and to establish criteria for expenditures from the fund; amend KRS 189.990 to impose an additional fee of $5 against certain moving violations to be deposited in the trust fund; amend KRS 189.390 to impose an additional fee of $10 against speeding violations to be deposited in the trust fund; and amend KRS 189A.010 to impose an additional fee of $15 against individuals convicted of DUI to be deposited in the trust fund; amend KRS 186.574 to conform.

     HCS - Delete exemption of Traumatic Brain Injury Trust Fund Board member from any personal liability or accountability for any loss sustained on account of any action or inaction of the board; Increase assessment of driving under the influence offenses from $15 to $20; Increase from $5 to $10 the find imposed against selected moving violations.
     HFA (1, M. Marzian) - Delete exemption of Traumatic Brain Injury Trust Fund Board member from any personal liability or accountability of any loss sustained on account of any action or indication of the board; increase assessment of driving under the influence offenses from $15 to $20; increase from $5 to $10 the fine imposed against selected moving violations.
     HFA (2, M. Marzian) - Delete exemption of Traumatic Brain Injury Trust Fund Board member from personal liability or accountability of any loss sustained on account of any action or inaction of the board; amend the language included in imposition of fines section to increase assessment of driving under the influence offense from $15 to $20, and the assessment for selected moving violations from $5 to $10.
