     AN ACT making appropriations for the operations, maintenance, support, and functioning of the judicial branch of the government of the Commonwealth of Kentucky and its various officers, boards, commissions, subdivisions, and other state supported activities.
     The Judicial Branch Budget Bill: appropriate in the Court of Justice moneys from the general fund, restricted funds, and federal funds totaling $160,585,500 in fiscal year 1998-99 and $178,960,500 in fiscal year 1999-00; provide for a 5% salary adjustment for fiscal year 1998-99 and 1999-00 for non-elected court personnel; provide for a 5% salary adjustment in fiscal year 1998-99 and 1999-00 for justices and judges; include salaries for circuit court clerks in fiscal year 1998-99 and 1999-00 as provided for in the judicial branch budget recommendation; provide general fund amounts for the actuarial assessed needs of the Judicial Form Retirement System; provide general fund amounts for the Court Facility Use Allowance Contingency Fund and the Court Designated Worker Case Management System; provide restricted funds for the Jefferson County Court Technology Improvement System; provide for the following local facility capital projects: Bell County $ 6,393,200 Christian County $ 9,560,800 Project Pool $ 18,507,300 Henderson County $ 8,019,800 Kenton County $ 4,515,600 Marshall County $ 7,383,800 Harrison County $ 6,152,000 Boone County $ 7,971,900 Fayette County $62,500,000 Lyon County $ 4,758,500 McCreary County $ 5,183,100 ADA Pool $ 3,952,200 Harlan County $ 5,857,400 Lewis County $ 5,299,700 McLean County $ 3,752,100; provide that the director of the Administrative Office of the Courts with the approval of the Chief Justice may expend any of the funds appropriated for the court operations and administration; provide that appropriated items and sums comply with KRS 48.311; provide that duplicate appropriations be governed by KRS 48.312; provide that revisions to restricted and federal funds be reported pursuant to KRS 48.630(10); require that the director of the Administrative Office of the Courts prepare a final budget document.

HB 320 - AMENDMENTS


     HCS - Retain the original provisions and provide $135,000 in each fiscal year, contingent upon passage of enabling legislation related to the judicial retirement plan rather than $200,000 in each fiscal year; provide $16,245,600 in the Project Pool rather than $18,507,300; include local facility project in Lincoln County in the amount of $2,260,000 and in Mason County in the amount of $4,531,700; provide for lease office and Court of Appeals space in Franklin County; provide that all court projects shall be in compliance with the standards as set by the National Center for State Courts; provide that the use allowance for the Fayette County Courthouse Parking Garage be based on the expanded scope totaling $8,500,000 and be set at an annual level of $4,000,000 and an annual use allowance sum not to exceed $500,000; defer the use allowance on the Fayette County Courthouse Project totaling $1,242,000 until FB 2000-02; authorize the expansion of the Kenton County Courthouse Project from $26,494,000 authorized in 1996 to $31,009,600 and defer corresponding use allowance payment totaling $696,000 to the next biennium; authorize expanded project scope of the Lincoln County Courthouse Project to $2,260,000; defer use allowance payments and related operating expenses until FB 2000-02 for courthouse project authorized in Bell, Christian, Henderson, Harrison, McCreary, Marshall, Lyon, Boone, Harlan, Lewis, and McLean counties; provide for use allowance payments for Henderson County Courthouse Project in the amount of $491,000 in fiscal year 2000, based on a June 1, 2000 occupancy, and for Mason County Courthouse Project from the Current Services budget in Local Facilities Fund totaling $131,000 in fiscal year 1999-2000; provide that any unexpended balance in the Contingency Fund shall not lapse but shall be continued; provide that project cost over-runs that exceed available funds in the Contingency Fund shall become a necessary governmental expense.
     SCS - Retain provisions of HB 320/GA with exceptions: provide funding for family, district, and circuit court judgeships, provide $500,000 for the court designated worker case management system and decrease the court facility use allowance contingency fund by $500,000; add Elliot County courthouse project and increase project pool scope; clarify language related to Fayette County courthouse project; and provide language in Part III relating to court facility use allowance.
     SFA (1, B. Bailey) - Delete the language provision that makes the Court Facility Use Allowance Contingency Fund effective, contingent upon passage of enabling legislation.
     CCR - Report that the conference committee could not agree and request free conference committee be appointed.
     FCCR (Majority Report) - Retain the provisions of the Senate Committee Substitute and provide for six additional law clerks for Jefferson County Circuit Court; establish an additional District Judgeship in Floyd County and delete the designation of the District Court Judgeship as a Family Court Judgeship; establish an additional Circuit Court Judgeship in Floyd County; establish the Warren County Circuit Judgeship effective September 1, 1998; establish an additional Circuit Judgeship as a Family Court Judgeship in Christian County; add the Elliott County Courthouse Project to the Project Pool and revise the Schedule of Authorized Projects and Multi-Year use Allowance Schedule; authorize expanded project scopes for Kenton County, Phase II, and Lincoln County Courthouse project.
