     AN ACT relating to warranties for new assistive devices.
     Create a new section of KRS Chapter 151B to require a manufacturer of an assistive device to expressly warrant the device against any condition, defect, or malfunction which substantially impairs the use, value, or safety of the device for a period of one year; establish a list of types of devices to be covered by a warranty; require the manufacturer to provide for refunds, repair, return, and replacement of devices; require an assistive device dealer to comply with all terms and conditions of the express warranty within thirty (30) days of a request for action by the assistive device lessor; require that full disclosure of returns or repairs on an assistive device be provided before sale or lease to a consumer; provide legal remedy for consumers.

HB 410 - AMENDMENTS


     HFA (1, J. Gray) - Exclude hearing instruments, as licensed under KRS Chapter 334, from the definition of assistive device.
     SCS - Require that only the manufacturer's invoice price be refunded in refunds involving hearing aids; retain all other provisions of HB 410/GA.
     SFA (1, V. McGaha) - Clarify definition of "assistive device" by excluding hearing instruments licensed under KRS Chapter 334.
