AN ACT relating to utilities.
     Create a new section of KRS Chapter 96 to allow a city water utility to extend lines, furnish water or sell water within or outside the utility's county of origin, if the residents do not already receive water service and are not included in a plan to receive water service within six months of a date of inquiry from another utility; amend KRS 74.020 to restrict a fiscal court from prohibiting the extension of a water distribution system to residents who are either not already served or not included in a demonstrable plan to receive water service within six months from an existing utility; amend KRS 96.150 to allow a city to extend the water supply or sanitary sewer system into a territory where persons are not already receiving water service and to delete the requirement that the utility extend only at the request of the water supply or district; amend KRS 96.045 to create an exemption for the city to construct additional plants or facilities for the extension of water service to residents not already receiving water service from an existing utility; amend KRS 96.538 to remove a water utility's dominant right to serve residents that are not already being served or that are not included in a plan to receive water service within six months from a date of inquiry; create a new section of KRS 278.010 to 278.450 to allow a water utility to extend lines, furnish water, or sell water within or outside the utility's county of origin, if the residents do not already receive water service and are not included in a plan to receive water service within six months of a date of inquiry from another utility.
