HB 423 (BR 1780) - W. Scott

     AN ACT relating to disaster and emergency response activity.
     Amend KRS 39.433 to exclude volunteers registered with the Division of Disaster and Emergency Services from liability for acts performed during emergency response activity except in cases of willful misconduct, negligence, or bad faith; extend to registered volunteers the same responsibilities and immunities of state employees, including defense by Attorney General where applicable.

HB 423 - AMENDMENTS


     HCS - Retain original provisions except also provide for registration of volunteers with local emergency and disaster response organizations; qualify that liability exists for gross negligence, rather than negligence; include volunteers in provision for payment of Attorney General for defense of state employees.
     SCS - Retain amendment of KRS 39.433; create a new section of KRS Chapter 39A, same as Section 24 of 1998 HB 453, but incorporating amendment made to KRS 39.433; specify that new section becomes effective and supersedes Section 24 of HB 453 if that bill becomes law.
