HB 468/FN (BR 1690) - P. Worthington

     AN ACT relating to the transportation of persons.
     Amend KRS 96A.010, regarding mass transit providers, to define the terms "human service transportation delivery" and "human service transportation delivery area"; amend KRS 96A.095, regarding mass transit services, to include human service transportation delivery as a service for which the Transportation Cabinet can receive funds, expand entities which can receive funds from the Transportation Cabinet, authorize the Transportation Cabinet to contract with transportation providers or brokers to provide human service transportation delivery, and authorize the Transportation Cabinet to promulgate regs; amend KRS 96A.170 and 281.605 to make technical corrections; amend KRS 281.635, regarding city bus franchises, to exempt human service transportation delivery vehicles under contract with the Transportation Cabinet from city authority; amend KRS 281.6185, regarding disabled persons transportation certificates, to prohibit the holder of a taxicab certificate from providing transportation in a disabled persons vehicle.

HB 468 - AMENDMENTS


     SCA (1, T. Buford) - Change the date of consideration of filed applications from July 1, 1998 to January 1, 1998; allow for taxicab applications filed prior to January 1, 1998 to elect to amend their pending applications so as to designate all or a portion as an application for approval to operate disabled persons carriers.
     SFA (2, G. Neal) - Amend to make technical corrections.
     SFA (3, T. Buford) - Allow individuals with valid taxicab license or certificates, as of January 1, 1998, to make application for a taxicab certificate limited to wheel-chair equipped vans to designate all or a portion thereof an application to operate disabled persons carriers.
     SFA (4, J. Rose) - Amend to delete nonemergency medical transportation under KRS Chapter 205 as a covered program under the definition of "Human service transportation delivery".
     SFA (5, J. Rose) - Amend Section 2 to add a subsection (6) which would require human service transportation brokers to provide applications for enrollment as a subcontractor to all providers and entities who qualify under this section; amend Section 7 to allow human service transportation providers to transport people who are not disabled in a disabled persons vehicle; change from July 1, 1996 to January 1, 1998 the date by which persons, engaged in the transportation of disabled persons under a valid cab certificate, shall be issued a certificate as a disabled persons carrier; allow an entity with a pending taxicab application filed prior to January 1, 1998 to amend the application to include approval to operate disabled person vehicles.
