HB 49/LM (BR 417) - K. Bratcher, T. Burch

     AN ACT relating to construction within floodplains.
     Create a new section of KRS Chapter 104 to place a moratorium on new construction in floodplains in counties with cities of the first class.

HB 49 - AMENDMENTS


     HCS/LM - Add conditions for construction for which building permits may be issued in a flood plain, and reduce time for moratorium from ten years to two years.
     HFA (1, R. Crimm) - Allow commercial property to be constructed in floodplain.
     HFA (2, K. Bratcher) - Allow the floodplain review board to approve or disapprove individual applications for construction in the types of construction permitted in subsection 2; create a new section in KRS Chapter 104 to set up a floodplain review board to review all applications for permits to build; and allow the board the power to deny construction if the construction will be harmful to persons and property in the floodplain; provide for administration and financing of the board.
     HFA (3, B. DeWeese) - Delete the provisions of the original bill and in its place provide that in counties with cities of the first class that permits be issued to buildings whose construction plans met the requirements of any applicable ordinances at the time the plans were initiated.
     HFA (4, K. Bratcher) - Delete the contents of the original bill and create a 19-member task force to study floodplain development in counties containing a city of the first class as provided, provide that the task force will begin its activities by August 31, 1998 and complete its activities by September 1, 1999 with a report to the LRC, require that the chair and vice chair be appointed from legislative members as provided, provide that the task force will be staffed by LRC and funded from the regular commission budget at approximately $30,000; and create a new section of KRS 104 to prohibit the enactment of local ordinances which would ban the construction of single family dwellings which are adjacent to a river and other single family dwellings immediately adjacent to the aforementioned properties.
     SCA (1, P. Herron Jr) - Create a new section of KRS Chapter 198B to require building permits to be issued to rebuild commercial businesses and single family dwellings located on properties in the floodplain in counties with cities of the first class and cities within those counties.
