HB 492 (BR 1146) - J. Wayne

     AN ACT relating to executive branch ethics.
     Amend KRS 11A.010 to delete from the definition of "officer" the members and full-time administrative officers of certain listed boards and commissions and to delete "any other management personnel with procurement authority"; create a new section of KRS Chapter 11A to prohibit a member of any board, commission, authority, council, or committee in the executive branch, either by himself or through a business in which he owns or controls an interest of more than 5% or which has a value of at least $10,000, or by any other person for his benefit, from doing business with the board, commission, et al, of which he is a member; exempt purchases that are available on the same terms to the general public or which are made at public auction; require a member of an executive branch board, commission, authority, council, or committee to disclose to the other members any direct or indirect conflict of interest; require the disclosure to be in writing and recorded in the minutes; require the member who discloses a conflict of interest to abstain from all decisions concerning that interest if the decision would affect him as a member of a business, profession, occupation, or group in a manner different from other members of that business, profession, occupation, or group; require members and full time chief administrative officers of certain listed boards and commissions to file financial disclosure; amend KRS 11A.990 to establish a civil penalty for those who fail to file financial disclosure by the specified date; require the penalty to be deducted from his salary upon order of the executive branch ethics commission and not to be recoverable under Section 235 of the Constitution of Kentucky.
