     AN ACT relating to insurance.
     Create a new section of KRS Chapter 304 Subtitle 39 to prohibit a reparation obligor from submitting medical expenses to a review process in order to negotiate a lesser rate for medical expenses incurred as a result of a loss to a basic reparation insured; amend KRS 304.39-210 to prohibit internal or external review of medical expenses by reparation obligor beyond the thirty day statutory limit; require a reparation obligor to make payments for loss in the order that the requests are received; allows obligor to accumulate benefits and to proceed in a specific manner if benefits are accumulated; and repeal KRS 304.39-240 which regards assignment of benefits.

HB 493 - AMENDMENTS


     HCS - Create a new section of Subtitle 39 of KRS 304 to allow a reparation obligor to negotiate a reduction of charges from a provider of services to a secured person, and that the secured person may not be billed for the difference between the cost of the full service and the negotiated reduction; amend KRS 304.39-210 to establish that benefits are not overdue if an obligor has not made payment to a provider due to the request of a secured person directing the elements of loss; create a new section of Subtitle 39 of KRS 304 to allow an insured to direct in writing the payment of benefits among the different elements of loss; and to repeal KRS 304.39-240.
