HB 519 (BR 1866) - F. Rasche, S. Cave, J. Coleman, R. Murgatroyd, R. Palumbo

     AN ACT relating to students.
     Create new sections of KRS Chapter 157 relating to programs for exceptional children to require individual education plans jointly decided by the parents and school personnel and require monitoring of the plans under administrative regulations of the Kentucky Board of Education; create a new section of KRS Chapter 157 to establish the Kentucky Special Education Mentor Program to be implemented by July 1, 1999 to select, train and assign highly skilled personnel certified in special education to local districts and schools that are not in compliance with state and federal laws and regulations; amend KRS 156.095 to require the Department of Education to provide a statewide professional development program during the 1998-1999 and 1999-2000 school years to address the characteristics and instructional needs of exceptional students and students at risk of school failure; amend KRS 157.200 to expand the definition of "developmentally delayed" students to serve students who are 3 through 8 years of age; amend KRS 157.224 to direct the Kentucky Board of Education to withhold funds from districts who are non compliant; amend KRS 157.360 to require that funds generated by exceptional students in the state funding formula be spent on the excess costs of programs for these students; and amend KRS 159.140 to require the Director of Pupil Personnel to interview students and their parents who quit school to determine the reasons, information shall be used for research and decision-making.

HB 519 - AMENDMENTS


     HCS - Retain original provisions; delete requirement that add-on funds generated under KRS 157.200 for exceptional children be dedicated to programs for exceptional children; require the Office of Education Accountability to conduct a study of paper-work requirements associated with special education programs and report the recommendations to the Interim Committee on Education; make technical corrections.
     SFA (1, L. Casebier) - Require that if a Kentucky Special Education Mentor recommends additional workdays they shall be paid by the Department of Education and be provided only for educators in affected schools; amend professional development provisions to remove statutory conflicts; require that withholding of add-on funds from local school districts be permissive and only after intense assistance is provided by the Department of Education, a Kentucky Special Education Mentor, or other approved assistance for a period of 2 years; require that all withheld funds be returned to the district when it is in compliance with all substantive requirements.
