AN ACT relating to law enforcement and fire protection.
Amend KRS 15.420 to add sheriffs and full-time regular deputies to KLEFP fund; amend KRS 15.440 to provide that sheriffs and deputies are eligible and provide that eligibility occur on an individual basis; amend KRS 15.460 to increase supplement to $3,000 annually; provide that sheriffs making maximum constitutional salary are not eligible; provide cut-off for payment when maximum reached; require each sheriff who participates in fund to forward copy of final settlement to the fund and require the sheriff to repay any overpayment by the fund; indicate routing of payment in fee-pooling or nonfee-pooling departments; ensure deputies' eligibility if sheriff fails to comply with provisions of section; amend KRS 95A.250 to increase FFP fund payments to professional firefighters to $3,000 annually; amend KRS 95A.262 to increase allotment to volunteer fire departments to $7,500 annually; make technical correction; amend KRS 42.190 to make technical correction.
HB 52 - AMENDMENTS
HCS/FN/LM/AA - Amend various sections of KRS Chapters 15 and 95A to add sheriffs, deputies, and state or public university police, including certain grandfather provisions, to the funds, and increase supplemental salary supplements of each from $2,500 to $2,750 until July 1, 1999, and then increase it to $3,000 thereafter; ensure that sheriffs making the maximum Constitutional salaries do not collect any money from the fund; amend KRS 15.440 to allow Kentucky Law Enforcement Council to raise basic training requirements by administrative regulations according to the results of a validated job task analysis; amend KRS 95A.262 to allow the sum paid to volunteer fire departments to increase from $5,000 to $6,500 until July 1, 1999, and then increase it to $7,500; amend KRS 15.430, 42.190, 95A.220, and 136.392 to allow funds accrued before July 1, 1999 to lapse, and after that date, to allow no more funds to lapse.
HFA (1, J. Vincent) - Amend KRS 15.420 to ensure that full-time deputies who provide court security are included in provisions of KLEFP fund.
HFA (2, S. Nunn) - Amend KRS 15.440 to ensure that sheriffs, deputies and state university police must enroll in continuing education courses for participation in the fund regardless of their date of entry into the program.
HFA (3, S. Nunn) - Amend KRS 15.440 to have sheriffs, deputies, and state university police hired after January 1, 1998 instead of those hired after the effective date of the Act take basic training course.
HFA (4/FN, H. Anderson) - Make parole officers eligible to participate in the program.
HFA (5/FN, H. Anderson) - Make state police eligible to participate in the program.
HFA (6/FN, H. Anderson) - Make wildlife conservation officers eligible to participate in the benefits of the program.
HFA (7/FN, H. Anderson) - Amend KRS 95A.262 to increase final rate of pay to volunteer fire departments in July 1, 1999 from $7,500 to $10,000.

Herron Jr) - Create a new section of KRS Chapter 70.260 to 70.273 to mandate that when a county forms a deputy sheriff merit board that copies of rules adopted are provided to the sheriff, county judge/executive, and legislative body of the county within 48 hours of their adoption, and delineate minimum subject matter to adopt rules on; create a new section of KRS Chapter 70.260 to 70.273 to require merit boards to employ a chief examiner who is responsible for the design, administration and evaluation of written tests required to achieve a promotion, require that the examiner select a panel to administer oral examination of candidates, delineate the composition of the exams, specify privacy in reporting scores, specify notice time of exams, specify sheriff's role in giving promotions.
