HB 567/LM (BR 1952) - J. Gray, J. Adams, G. Stumbo, P. Worthington

     AN ACT relating to the zoning of manufactured housing.
     Amend KRS 100.111 to include manufactured homes in definitions; create a new section of KRS Chapter 100 to recognize federal acts pertaining to manufactured housing, except provisions of the Act from application to mobile homes, preclude cities and counties from discriminating against manufactured housing in terms of zoning and land-use regulations, allow for the local governments to require removal of transporting equipment, require foundations used in manufactured homes to be in accordance with state law, and mandate that within 2 years of the bill's passage that local governments review and construct a written report detailing status of their compliance with this Act; amend KRS 100.203 to include manufactured homes and allow them in agricultural zones, and allow them in residential zones if the foundations are installed according to state standards, their exterior siding, roofing, and exterior covering material are not out of character with surrounding structures, and limit effects of Act.

HB 567 - AMENDMENTS


     HCS - Delete provisions of bill with the exception of referring to the definition of "manufactured home" in KRS 227.550, retaining exemption of mobile homes from provisions of bill, applying the Act to new manufactured homes placed upon a permanent, continuous masonry or concrete foundation and footer for the first time after the effective date of the Act, replacing rest of the section with an encouragement to cities, counties, urban-counties and charter counties to not adopt or enforce zoning or land use regulations that discriminate against manufactured homes that meet the National Manufactured Home Construction and Safety Standards Act and also meet the architectural and aesthetic standards required of single family structures in the same zoning district, and clarifying that this Act does not affect, modify, or abolish restrictions contained in various legal instruments; and retain application of manufactured homes within KRS 100.203.
