HB 61 (BR 808) - J. Clarke

     AN ACT relating to civil actions.
     Amend KRS 391.035 to make a court judgment pertaining to intestate succession conclusive evidence of the facts determined therein as against all parties, whether known or unknown; amend KRS 395.278 to prohibit the revival of a civil action in the name of or against a personal representative or successor of a deceased party more than 6 months after the appointment of the personal representative, or if no personal representative has been appointed, more than 2 years after the decedent's death; amend KRS 396.205 to limit civil actions against a personal representative or distributee.

HB 61 - AMENDMENTS


     HCS - Delete the provision which prohibits the revival of a civil action in the name of or against a personal representative or successor of a deceased party more than 6 months after the appointment of the personal representative, or if no personal representative has been appointed, more than 2 years after the decedent's death.
