     AN ACT relating to highway signage.
     Create new sections of KRS Chapter 177 to define brown sign, historical site, and tourist area or attraction; require the commissioner of the Department of Highways to promulgate regulations concerning applications for a brown sign; require the criteria to be based upon average annual attendance and distance from a highway; require the commissioner of the Department of Highways to approve or reject an application within 90 days of its receipt; specify the required contents of an application for a brown sign; require a one hundred dollar nonrefundable application fee; create standards for the usage of supplemental guide signs.

HB 612 - AMENDMENTS


     HCS - Increase the distance standard for approval to fifty miles; provide that supplemental guide signs and limited supplemental guide signs erected prior to July 1, 1998, shall not be removed because of site selection criteria; require the commissioner of the Department of Highways to provide written notification to an applicant within thirty days of hearings to be held on an application, and require the commissioner of the Department of Highways to provide written notification of a decision to an applicant; require the Department of Highways to consult with selected local groups to determine signage approval; make technical corrections.
     HFA (1, J. Vincent) - Grant authority to design, erect, maintain, regulate, and control supplemental guide signs and post-interchange guide signs for tourist areas and attractions and historical sites to the Tourism Cabinet; require any funds allocated to the Transportation Cabinet for the purpose of designing, erecting, maintaining, regulating, and controlling supplemental guide signs to tourist areas and attractions and historical sites be transferred to the Tourism Cabinet for these purposes; repeal, reenact, and amend KRS 177.073 to require the Tourism Cabinet to take responsibility for official directional signs pertaining to publicly and privately owned tourist attractions and outdoor recreation areas.
     SCS - Retain original provisions, except define "fully controlled access highway" in lieu of "interstate"; replace the $100 per year annual fee for a limited supplemental guide sign with a provision allowing a fee of up to $500 per year for a period of ten years; delete language in Section 4 establishing requirements for post-interchange guide signs; amend KRS 177.0734 to define "partially controlled access highway".
     SFA (1, D. Boswell) - Change "interstate" to "fully controlled access highway"; include definition of "logo sign," "partially controlled access highway," and "specific service sign"; change reference to "urban area" to "city"; amend fee structure to be paid to the Department of Transportation upon approval for a supplemental guide sign to either $500 per year for a period of ten years or to the cost of the sign amortized for a period of ten years, whichever is lesser; amend Section 4 by deleting subsections 2 through 6, and by including directives on an application to experiment with post-interchange guide signs to include permission for a maximum of three tourist attractions or historical sites per sign, permission to erect post-interchange guide signs up to 35 miles from a fully controlled access highway; and permission to erect post-interchange guide signs at any fully controlled access highway interchange to a limited access highway, interstate, or parkway; amend KRS 177.0736 to include interchanges on partially controlled access highways.
