HB 618 (BR 2051) - R. Palumbo

     AN ACT relating to health insurance coverage for cancer drugs.
     Amend KRS 217.005 to revise definition of "drug" to include articles recognized in the American Hospital Formulary Service Drug Information; clarify that "United States pharmacopoeia" refers to the United States Pharmacopoeia; create a new section of Subtitle 17A of KRS Chapter 304 to require all health benefit plans not to exclude coverage of cancer drugs when used for an indication other than one on its label if the drug is recognized for that indication in the official compendium or medical literature; include services necessary to administer the drug; state that coverage is not required for drugs not approved by the Food and Drug Administration, when there are contraindications, or for experimental drugs; create a panel of medical experts to review off-label uses and make recommendations for use; give commissioner of insurance authority to authorize payments for off-label drugs.

HB 618 - AMENDMENTS


     HCS - Amend by deleting the definition changes.
     HFA (1, R. Palumbo) - Retain original provisions except delete references to definition of drug compendium.
     HFA (2, R. Palumbo) - Retain original provisions except require professional journal publication meet specific criteria and include documentation regarding drug safety and effectiveness; require reimbursement if the drug has been prescribed for cancer patient and recognized as safe for cancer treatment; exclude reimbursement when drug provider does not have contract with health maintenance organization or is excluded from provider's formulary; stipulate that panel of medical experts will be appointed by commissioner, with recommendations from the Kentucky Medical Association, rather than appointed by Kentucky Medical Association; require panel to conduct meetings in accordance with open meetings provisions of KRS Chapter 61.
     SCA (1, R. Roeding) - Amend to delete conditional waiver of required coverage of cancer drugs by health maintenance organizations.
