HB 62/LM (BR 815) - P. Clark, C. Walton

     AN ACT relating to election and declaring an emergency.
     Amend KRS 116.055 to establish December 31 immediately preceding a primary as the date by which a voter may change political party affiliations and still be eligible to vote in the next primary; amend KRS 118.125 to conform the candidate filing forms to comply with the changes made in KRS 116.055; amend KRS 118.315 to establish December 31 immediately preceding a regular election as the date by which a person must have been registered as an independent to be on a regular election ballot as an independent candidate; amend KRS 116.112 to permit a county clerk to request, and to require a public utility to provide, information regarding customer service address changes to assist the clerk in maintaining voter registration records; amend KRS 117.045 to eliminate the requirement for appointment of precinct election officers in non-election years unless a special election is ordered in a non-election year, and to permit a county board of elections to appoint up to two additional precinct officers for a precinct, and to permit persons to serve as precinct election officers who have been registered as a member of a political party for one, instead of two, years; amend KRS 117.075, 117.077, 117.085, 117.086, 117.0863, and 117.087 to clarify language regarding absentee ballots; amend KRS 117.187 to specify that precinct election officers must be trained before each primary and regular election; amend KRS 117.227 to permit a precinct election officer to confirm a voter's identity by use of any identification which displays the voter's picture and signature and to eliminate the option for a voter with no identification to complete a voter's oath and to be allowed to vote; amend KRS 117.255 to restructure the language regarding requests for and receipt of assistance in voting to require that all persons requiring voting assistance be assisted by two precinct election judges unless they have brought someone with them to provide assistance; amend KRS 117.265 to prohibit a person from being a write-in candidate for more than one office in an election to eliminate the exemption for candidates for municipal office in cities of the fifth and sixth class from filing declarations of intent to receive write-in votes; create a new section of KRS Chapter 121 to prohibit paying or accepting anything of value for transporting voters to the polls; amend KRS 119.205 to conform with the prohibition against paying or accepting anything of value for transporting voters to the polls; amend KRS 160.210 to permit a school board to alter school board district boundaries more often than every five years when necessary to conform with voting precinct boundaries; provide that voters who have changed political party affiliations since the last regular election up to the effective date of the Act would be allowed to vote in their new party's primary in May, 1998 and that persons who are not registered to vote on the effective date of the Act who register after the effective date of the Act while the registration books are open may vote in the primary if they have not changed their party affiliation since registering; EMERGENCY.

HB 62 - AMENDMENTS


     HCS/LM - Retain provisions of the bill as introduced, with the following changes: delete the provisions allowing a county clerk to request information regarding customer service addresses from a utility company, which the utility company must provide if requested; delete the provisions prohibiting paying someone to transport voters to the polls on election day; and restore the exemption for candidates for municipal office in cities of the fifth and sixth classes from filing a declaration of intent to receive write-in votes for the votes to be counted; EMERGENCY.
     HFA (1, G. Stumbo) - Amend KRS 117.085 to permit voting by paper absentee ballot for persons whose employment location prevents them from voting in person at polls on election day and from casting an absentee ballot in person in the county clerk's office prior to the election.
     HFA (2, R. Palumbo) - Restore new section of KRS 121 to the bill to prohibit paying a person for transporting voters to the polls on election day and restore amendment of KRS 119.205 to conform.
     HFA (3, R. Murgatroyd) - Delete exemption for persons seeking write-in votes for city office in a city of the fifth or sixth class from filing a declaration of intent to receive write-in votes.
     HFA (4, R. Murgatroyd) - Delete the exemption for candidates in cities of the fifth and sixth class from filing a declaration of intent to be a write-in candidate.
     HFA (5, G. Stumbo) - Amend KRS 117.085 to permit voting by paper absentee ballot for persons whose employment location prevents them from voting in person at the polls on election day and from casting an absentee ballot in person in the county clerk's office prior to the election; and make a technical correction.
     HFA (6, D. Ford) - Change the cutoff date for a voter to be registered as a member of the political party in whose primary election he seeks to vote from December 31 of the preceding year to the date on which the registrations books close before a primary, twenty-eight days before the primary.
     HFA (7, M. Marzian) - Allow any person who does not qualify to vote by paper absentee ballot to vote in the county clerk's office prior to an election without having to meet the requirement that the voter will be out of the county on the day of an election.
     HFA (8, G. Stumbo) - Restore new section of KRS Chapter 121 to the bill to prohibit paying a person for transporting voters to the polls on election day in counties in which a mass transit system is operational and to restore the amendment to KRS 119.205 to conform.
     SCS/LM - Retain provisions of HB 62/GA with the following changes: delete the amendment to the partisan candidate filing form to avoid a statutory construction conflict; clarify the language allowing a person to vote by paper absentee ballot who will be out of the county because of his employment during all times that absentee voting is conducted on a voting machine in the county clerk's office; and delete the provisions concerning the confirmation of a voter's identity by a precinct election officer.
     SFA (1, R. Roeding) - Change the date by which a voter must be registered as a member of a political party to be eligible to vote in that party's primary from December 31 of the preceding year to the partisan candidate filing deadline on the last Tuesday in January preceding the primary and change the date by which a person wishing to be an independent candidate in a regular election must not be affiliated as a member of a political party from December 31 preceding the regular election to the last Tuesday in January preceding the regular election.
